Network Management Policy
Broadband Internet Access Services Disclosure
This Disclosure outlines the terms, conditions, performance characteristics, and network management practices applicable to Flex Mobile’s provision of Broadband Internet Access Services (“Services”) via our third-party network provider’s 4G LTE and 5G mobile broadband networks (the “Network”). The following applies solely to the Services provided directly through Flex Mobile’s Network and does not extend to usage occurring via any roaming partner network. I. Governing Terms
All Services are provided in accordance with Flex Mobile’s T&Cs, which incorporate by reference Flex Mobile’s Privacy Policy and Acceptable Use Policy (“AUP”), both of which are available at https://www.getflexmobile.com/policies/terms-of-service. The T&Cs are subject to change at Flex Mobile’s discretion; customers are advised to review them periodically, including prior to activation or renewal of Services. The T&Cs include provisions on prohibited uses, dispute resolution procedures, and data handling.
II. Data Plans and Usage Management
Flex Mobile offers a variety of data plans that provide access to the Services through compatible devices. Availability of 4G LTE and/or 5G services is contingent on the use of a compatible device and SIM card within a qualifying coverage area. All data plans include a predetermined allotment of high-speed data per monthly billing cycle.
Upon consumption of the applicable high-speed data allotment—e.g., 25GB of 4G LTE and/or 5G data for both the Unlimited and Unlimited Plus plans—data transmission speeds may be reduced or access temporarily suspended for the remainder of the billing cycle. Speed reductions may materially impact data-intensive activities, including but not limited to video streaming, online gaming, and large file transfers.
In addition, Flex Mobile’s Network Supplier may implement network management practices, including deprioritization, during periods of high network congestion. Video streaming is generally limited to a resolution of 480p. All data services are intended for personal, domestic use unless international roaming is explicitly permitted under the T&Cs.
III. Performance Expectations
Speed: Network speed refers to the rate at which data is transmitted over the Network, generally measured in kilobits or megabits per second (Kbps or Mbps). Certain applications require higher speeds for optimal performance.
Latency: Latency refers to the time required for a data packet to travel from source to destination and back, typically measured in milliseconds (ms). Low latency is critical for real-time applications such as video conferencing.
Expected average performance for users on broadband-capable devices within covered areas is as follows (actual performance may vary due to environmental and network conditions):

IV. Network Management Practices
A. Blocking
Flex Mobile does not block access to lawful content, services, or applications except as required to implement our network management practices, comply with applicable law, or enforce the T&Cs and AUP.
B. Throttling
Flex Mobile does not intentionally impair or degrade access to lawful content, applications, or services based on content or device type. However, speed reductions may be applied after high-speed data thresholds are exceeded or during periods of network congestion, as detailed above.
C. Prioritization
Flex Mobile does not prioritize or favor certain Internet traffic over others. Nonetheless, our Network Supplier may engage in traffic management practices that result in the deprioritization of certain users during network congestion.
D. Congestion Management
To ensure fair access for all users, Flex Mobile and/or its Network Supplier may implement temporary speed reductions or similar traffic management mechanisms during peak usage periods. Such measures are content-neutral and based solely on real-time network demands.
E. Application-Specific Behavior
Flex Mobile does not block, rate-control, or otherwise discriminate against lawful applications that are compatible with our Services. Protocols and applications are treated in a neutral manner, subject to our standard network management practices and security protocols.
F. Device Attachment Rules
Customers must utilize supported, compatible devices to access the Network. Flex Mobile maintains a list of approved devices available upon request. The use of unsupported devices—including modems, gateways, automated relay devices, and other commercial or redirection tools—is strictly prohibited and constitutes a violation of the AUP, which may result in immediate service termination.
G. Security
Flex Mobile reserves the right to implement measures it deems necessary to ensure network integrity and security, in accordance with the T&Cs, Privacy Policy, and AUP.
